When the matter is called out, learned Advocate for the respondents produces a photocopy of pursis on record filed in the Trial Court stating that he is not proceeding against present petitioner, who is respondent No.2 in M.A. No.47 of 2018, pending before the learned JMFC, Omerga. Said pursis is taken on record.

In view of this, present petition has become infructuous. Learned Advocate for the petitioner also accepts the position. Hence, the petition is disposed off.

Learned Advocate for the respondents states that his clients are old aged persons of 75 and 70 years of age. Though they are not willing to proceed against present petitioner, however, they are very much proceeding against their son, who is respondent No.3 in this petition and prays for

( 2 ) crwp517.22 directions to the learned Trial Court to expedite the hearing of M.A. No.47 of 2018.

The learned Trial Court is, therefore, requested to dispose off M.A.No.47 of 2018 as early as possible and preferably within a period of six months from today.
