This matter was heard at length yesterday. After the extensive hearing was concluded, the learned AGP sought a pass over to take instructions, whether the impugned order is being withdrawn by the Competent Authority.

The copy of the communication dated 07.02.2024, addressed to the learned AGP by Shri Dilipkumar Rathod, Regional Deputy Director, OBC Welfare (Regional), Division Latur, has informed that the impugned order dated 20.01.2018 is being recalled and the approval granted to the Petitioner will be

(( 2 )) 905-WP-4050-2018 restored. The copy of the said communication is taken on record and marked as "X-1" for identification.

In view of the above document, the impugned order dated 20.01.2018 stands recalled. Consequentially, this Writ Petition is rendered infructuous. The same is therefore, disposed off. Needless to state, we have not made any observations as regards the earlier approval to the probationary period of the Petitioner. The proposal which would now been pending before the authority, would be considered on its own merits, within sixty days. 4.

Needless to state, as regards the passing reference made by the said authority in "X-1" that the Petitioner is not in employment, since she was remaining unauthorizedly absent from 29.08.2016 till January 2018, we leave the issue open in order to enable the Petitioner to avail of a remedy as may be permissible in law.
