PER COURT :- 1.
Mr. Karad, learned counsel for respondents No.2 and 3 states that if the petitioner makes a representation to the Municipal Corporation, Aurangabad, the Respondent Corporation will hear the petitioner and shall take decision afresh without being influenced by the order dated 23.7.2014 passed by the Education Officer.

Mr. Choudhary, learned counsel for the petitioner states that the petitioner is agreeable to make a representation to the Respondent Corporation and the respondent Corporation be directed to take decision without being influenced by the order dated 23.7.2014 passed by the Education Officer. It is already submitted by the learned counsel for the respondents Corporation that, respondent Corporation would take decision afresh independently and without being influenced by the order of the Education Officer.

In light of that, we pass following order.
O R D E R
1] The petitioner shall make a fresh representation to the Respondent Corporation though its Commissioner. In case such a representation is made, the Respondent No.2 Commissioner shall decide the same on its own merits, after hearing the petitioner in accordance with law and without being influenced by the order passed by the Education Officer dated 23.7.2014. 2] The said decision be taken within a period of two months from the date of receipt of the representation. 4.
