Applicants are praying for withdrawal of amount for the reasons stated in application. The bread earner of the family died in an accident and the applicants are in need of money. 2.

Learned counsel Mr. Swapnil Patil for the respondent/insurance company submits that its a case of contributory negligence. He is seriously assailing quantum. 3.

In pursuance of the order passed by this Court, respondent/insurance company deposited Rs.60,14,582/-. Considering the submissions of both sides, interest of justice would be subserved in permitting the applicants to receive 50% of the amount deposited.

Civil application is partly allowed.

Applicants are permitted to withdraw 50% of the amount deposited in this Court on furnishing usual undertaking.
