ORDER

Present appeal is related with Dongargaon High Depth Barrages, Latur. Today respondents / claimants are present personally along with their respective counsel.

For the State of Maharashtra, learned AGP Mr. S. S. Dande, Mr. A M. Phule along with Mr. G. K. Joshi, Executive Engineer, Latur Minor Irrigation Division, latur and on behalf of appellants Acquiring Body Mr. S. G. Sangale and on behalf of respondents Mr. R. K. Ashtekar, are present. 3.

The statement is made on behalf of the Acquiring Body to the effect that claimants/ respondents on their own approached to the Acquiring Body. In this matter the appellant is the Executive Engineer, Latur Minor Irrigation Project Division, Latur, who is acquiring authority. The acquiring authority made a statement that the respondents/ claimants had

2 FA 3032-2018 approached to them with a proposal in writing that all the respondents/ claimants are ready to compromise the matter and accept the amount as per the Government Resolution dated 3rd November, 2016 that is in respect of payment of compensation at the rate of four times of the amount granted by the Special Land Acquisition Officer. The respondents/ claimants have accordingly submitted the compromise application, which is taken on record as form "X"

The respondents/claimants are ready to give up their claim which is excess to the amount determined as per Government Resolution dated 3rd November, 2016, granted by the Reference Court and corrigendum dated 23-02-2017 and 13-08-2018.

In view of the form "X" which is submitted by respondents/claimants, the first appeal is accordingly disposed of in terms of compromise form "X". 6.

The officer present on behalf of Acquiring Body undertakes to make the payment as per compromise within a period of six months from the date of order. The respondents/ claimants made a request that amount be deposited in the Court of Civil Judge, Senior Division, Nilanga, Dist. Latur. The request is allowed. The amount be deposited in the Court of Civil Judge, Senior Division, Nilanga Dist. Latur. Recalculation of amount shall be made accordingly. Claimants are at liberty to withdraw the same. The undertaking is accepted.

The chart is submitted by parties giving details in relation to the first appeal, party name, LAR number, area and the amount of settlement in Lok-Adalat. The chart is taken on record and marked as "Y". 8.

In view of above, the appeal is disposed of. The Court fee if any paid in the respective appeals, shall be refunded back according to rules.
