Both the sides submit that instead of hearing the present application for withdrawal of amount (C.A. No. 5835/2014), the first appeal itself can be heard finally.

Accordingly, the present application (C.A. No. 5835/2014) is disposed of. The stay to the execution of

ca5835-14 the impugned award, granted earlier, is hereby made absolute on the same terms and conditions. In the circumstances, civil application No.

766/2014 accordingly stands allowed and disposed of.

Place the first appeal for final hearing on 17th February, 2015. Call R & P. Mr. S.R. Bodade, learned counsel for the respondents submits that hamdast be granted so that the R & P would be received before the next date. The learned Commissioner, Workmen's Compensation, Jalna is directed to see that the R & P reaches this Court before 17th February, 2015. Stand over to 17th February, 2015.
