Learned Counsel for the respondents raised an objection that alternate remedy is available under Section 451 of the Maharashtra Municipal Corporations Act, 1949 before the State government to challenge the resolution. 2.

In view of that the writ petition is disposed of with liberty to the petitioner to avail the alternate remedy as contended by the respondents for a period of ten days. The respondents shall not allot work order pursuant to the tender notice. The protection granted by this Court shall come to an end after ten days.
