Heard. Learned Counsel for the petitioner.

The petitioner has been terminated for his absence more than three years from his duty in view of Rule 16(3) of the Maharashtra Employees of Private School (Conditions of Services) Rules, 1981. The termination date is 29.02.2008. The petitioner did not impugned the order and directly seeking relief that his employer should send his proposal for his pensionary benefit. 3.

Since the termination order is not challenged before the competent authority, we are of the view that no relief as such can be granted. The petitioner is at liberty to take appropriate remedy as is available in law.

For the above reasons, petition stands dismissed. 5.
