( 1 ) 928 wp 10964.16
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 928 WRIT PETITION NO. 10964 OF 2016 PANDURANG RAMKISHAN BENGDE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioners : Mr. Deshpande Gaurav L. AGP for Respondents: Mr. S.B. Yawalkar ...

P.C. :- .
This writ petition is entirely frivolous. There is no cause of action for it. If the petitioner says there are no acquisition proceedings subsisting or otherwise, no award, then, there is no question of any claim for compensation. No representations made in the garb of seeking compensation can be considered for we see a clear attempt and device to pressurize and force the authorities to some how commence the acquisition proceedings. It is entirely for the authorities to decide whether they require any land and particularly a private land for a public purpose.
2.
We do not think that any direction can be issued to consider the petitioner's representation. More so when there is no legal basis for
( 2 ) 928 wp 10964.16 the claim. We can very well see the design and pattern emerging from such litigation for an order of this Court or a direction to consider the representation, if not obeyed and followed, results in another round in the form of Contempt Petition and trying to exert more force and pressure on the authorities. It is time we nip these attempts in the bud. The writ petition is, therefore, dismissed.
