Heard the learned counsel for the applicant and the learned APP for the respondent-State.

Learned counsel for the applicant states that he was playing with other co-accused, hence, he has been arraigned as an accused. As against this, learned APP would argue that the applicant was seen present at the time of the incident. But record reveals that the applicant had played no active role. Nothing is to be recovered from him. Hence, it would be inappropriate to keep him behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SHAIKH ALIM SHAIKH KALIM be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.06 of 2023, registered by Police Station Chikalthana, District Aurangabad, for the offences punishable under Sections 307, 324, 323, 504, 506, 143, 147, 148, 149, 427, 504, 506 read with Section 34 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the Police Station as and when called by the Investigating Officer on written notice.
