None present for respondent nos. 1 to 6, though served with notice. 2.

This is an application filed by the appellants for condonation of delay of 1938 days caused in filing First Appeals.

The grounds stated in the application for condonation of delay are that some time was consumed for taking legal opinion of Law and Judiciary Department and after its recommendation, appeal proposal was sent by the concerned A.G.P.

ca7342.13 to the Law and Judiciary Department, Aurangabad. Then the Law and Judiciary Department forwarded the said proposal to the Government Pleader, High Court, Bench at Aurangabad. After receipt of proposal, the appeal memo was prepared.

Therefore, time was consumed due to the procedural aspect and approval of the Law and Judiciary Department.

In view of above, I am of the opinion that the delay caused has been satisfactorily explained. Therefore, same is liable to be condoned. Accordingly, delay is condoned.
