ORDER:- 1.

Heard learned Counsel for the applicant - wife. The respondent husband, though served with fnal disposal notice, remained absent.

The applicant - wife is seeking transfer of Hindu Marriage Petition No.162 of 2022 pending in the court of Civil Judge (Senior Division), Baramati, District Pune fled by respondent husband for getting divorce, to the Court of Civil Judge (Senior Division), Shrirampur, District Ahmednagar. According to the applicant-wife, she is residing at Shrirampur which is 175 kms away from Baramati. Moreover, she has also fled one proceeding against the respondent husband at Shrirampur under under the provisions of Protection of Women from Domestic Violence Act, 2005. Besides, the applicant is also having one 5 years old son from the

(2) 977 MCA-114.2022.odt respondent - husband and not having any independent source of income. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) HMP No.162 of 2022 pending in the Court Civil Judge (Senior Division), Baramati, District Pune is transferred to the Court of Civil Judge (Senior Division) at Shrirampur, Dist Ahmednagar for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division) at Shrirampur on 21st November 2022.

(iv) The application is disposed of accordingly.
