Learned Advocate appearing for the appellant i.e. the legal heir as directed to be brought on record in C.A. No.3672 of 2019 is present and he has filed a pursis along with certified copies of compromise, which had taken place between the parties in R.C.S. No.434 of 2016. The said suit appears to be for partition, in which, it is stated that the present suit property was also involved. It is submitted that in view of the said compromise the appellant has no dispute to proceed with the appeal and therefore, on instructions, the learned Advocate for the appellant withdraws the Second Appeal. He allowed to withdraw the Second Appeal, as prayed. No order as to costs.
