ORDER :

Heard the learned counsel for the applicant. He has requested for quashing and setting aside the order made by the learned Judicial Magistrate, First Class (Railway), Aurangabad by which 'B' summary report filed by investigating agency is accepted. It appears that the said order is not challenged by filing revision.

The second prayer is made that the investigating agency should make further investigation. These powers are there with J.M.F.C. and as the revision can be filed in the Court of Sessions, this Court holds that it is not desirable to entertain the present proceeding. It involves the consideration of material already collected by the police which can well be done by the Sessions Court.

Disposed of as withdrawn.
