1] Heard learned counsel for the petitioner.

2] We have perused the case diary produced by the learned A.P.P. We have also perused the statements immediately recorded after the death of Tanaji, the brother of the petitioner. Statements unequivocally show that Tanaji was under depression due to unemployment and was not conducting properly nor taking the food properly and was in mental tension and as such he himself decided to commit suicide and committed suicide by jumping before the train.

crwp485.15 3] In that view of the matter, the F.I.R. lodged after 2 months and 8 days does not appeal to be sound. We find no fault in the investigating machinery.
