This petition takes exception to order refusing to condone the delay of around five years in filing appeal under Order 43 Rule 1(r) of the Code of Civil Procedure.

The learned Advocate for the petitioner states that the petitioner will be satisfied if the proceedings in Special Civil Suit No.243 of 2012 are expedited.

Perusal of the plaint will demonstrate that almost all the parties are senior citizens. The suit is filed in the year 2012. In such circumstances, it will be appropriate that the said suit is expedited. 4.

The learned 5th Joint Civil Judge, Senior Division, Aurangabad is directed to decide the Special Civil Suit No. 243 of 2012 expeditiously and in any case on or before 31.08.2026.
