The learned Advocate for the respondent sought a pass over to take instructions.

After the matter was called out post lunch, the learned Advocate for the respondent submits, on instructions that Shri Pradip V. Bavkar, retired Principal District Judge and presently residing at Mumbai can be appointed as an arbitrator. The learned Advocate for the applicant consents for such appointment.

In view of the above, this application is allowed and Shri Pradip V. Bavkar is appointed as a sole arbitrator. It is made clear that the issues to be considered by the learned arbitrator would be restricted to the extent of the claim of the applicant for damages and interest amounts.

The applicant shall deposit an amount of Rs.5000/- (Rupees Five Thousand only) in this Court, on or before 15/06/2019, as processing fees. Thereafter, the office shall process the papers to be placed before the learned arbitrator. (RAVINDRA V. GHUGE, J.) shp/-
