Perusal of the application shows that the delay of 09 days caused in filing Criminal Application for leave to file Appeal against the order of acquittal dated 12.01.2023 passed by Additional Chief Judicial Magistrate, Ahmednagar in Summary Criminal Case No. 6328 of 2019 is satisfactorily explained. No mala fides can be attributed 1/2

against applicant for causing of the said delay. Hence, the following order:

ORDER

(i) The application is allowed in terms of prayer clause ' A'.
