DATED : 27 th April, 2015 PER COURT :- 1] By the present application, the applicant is seeking his release on bail since he is arrested in connection with Crime No. 18 of 2015, registered at Mohadi police station, District Dhule, for the offences punishable under Sections 328, 420, 482, 484, 486, 488 of the Indian Penal Code and Sections 65(b)(c)(d)(3)(4), 67, 83, 86 of the Bombay Police Act. 2] I have heard Shri N.L.Choudhary, learned counsel for the applicant and Shri A.S.Shinde, learned Additional Public Prosecutor for the respondent/State.
3] The first information report is lodged by police Head Constable Sandip Narayan Khairnar. According to the first information report, the police party got a secret information that in agricultural field owned by Rajendra Ananda Marathe illicit distillery is functioning. According to first information report, when the police party reached to the spot, one person ran away from the spot and it was subsequently made known to the police patil that the person who ran away from the spot is the present applicant.
crap1899.15 4] The statements recorded by the investigating officer show that the person who ran away from the spot is the present applicant. Entire material and contraband is also seized from the spot itself. The applicant is in jail since 22.2.2015. The learned Additional Public Prosecutor submits that though charge sheet is not filed entire investigation is over and the report the Chemical Analyser is yet to be received. Since the entire investigation is over, further custodial presence of the present applicant is not at all necessary looking to the accusations made in the first information report. Hence, I pass following order.
O R D E R
(i) Criminal Application is allowed.
(ii) Applicant-Pawan s/o Satyanarayan Agrawal be released on bail, in connection with Crime No. 18 of 2015, registered at Mohadi police station, District Dhule, for the offences punishable under Sections 328, 420, 482, 484, 486, 488 of the Indian Penal Code and Sections 65(b)(c)(d)(3)(4), 67, 83, 86 of the Bombay Police Act, on he executing P.R.bond of Rs.50,000/- with two solvent sureties in the like amount.
(iii) Bail before the trial court.
(iv) The applicant-Pawan s/o Satyanarayan Agrawal shall attend Mohadi police station twice a week, preferably on every Sunday and Wednesday in between 3.00 p.m. to 5.00 p.m. till filing of the charge sheet.
(v) Application is disposed of.
