With regard to removal of encroachment, Gram Panchayat has power under Section 53 of the Maharashtra Village Panchayats Act. The Gram Panchayat need not approach the Court. It can take recourse to Section 53 of the Maharashtra Village Panchayats Act and can remove the illegal encroachments made.

The police authorities may consider the application filed by the petitioner for police protection on its own merits. With these observations, the writ petition is disposed of. No costs.

All the contentions are kept open.
