Learned advocate for the petitioner, on instructions, seeks leave to withdraw the writ petition in view of appeal having been preferred pursuant to section 33 of the Maharashtra Village Panchayat Act, 1958 against the decision rendered by the Collector.

As such, leave granted. Writ petition is allowed to be withdrawn. It is open for the parties to take up all contentions in the matter of delay condonation before the Commissioner. Writ petition stands disposed of as withdrawn.
