It appears that the action was taken by Corporation on the basis of the complaint given by present petitioner and in the case filed by police as summons case under section 52 of M.R.T.P. Act the Respondent is acquitted. In view of the provisions of section 372 of Cr.P.C. and the provisions of Section 401 (5) of Cr.P.C. the appeal ought to have been filed but revision is filed and so the proceeding can be treated as appeal. Learned counsel for the Petitioner sought permission for the same.
