In this Writ Petition, the Petitioner challenges the order dated 25.11.2003, by which the Respondents have refused to grant approval to the appointment of the Petitioner on the post of Hostel Superintendent in Shri Ghadge Maharaj Prathamik Ashram School at Sitakhadi, District Nanded, on the ground that the Petitioner does not have D.Ed. qualification. 2.

A Division Bench of this Court, while entertaining the Writ Petition, passed an interim order on 25.01.2006 in Civil Application No.9746 of 2005, which continued to operate.

The learned Counsel for the Petitioner submits that the issue involved in this Writ Petition is no longer res-integra and has been answered in favour of the Petitioner by a Division Bench of this Court in Balaji Bapurao Chandanwar vs. State of Maharashtra and others1. The aforesaid statement has not been disputed by the learned Counsel for the Respondents. 4.

For the reasons assigned by the Division Bench of this Court in Balaji Bapurao Chandanwar (supra), the order dated 25.11.2003, is quashed and set aside. The Respondents are directed to grant approval to the appointment of the Petitioner within a period of four (04) weeks from today. 5.
