Learned counsel appearing for the applicants, on instructions, seeks permission to withdraw this criminal application with liberty to take out appropriate proceedings taking exception to the charge sheet.

In fact liberty was granted to the applicants, by order dated 18th June 2015, to take out the appropriate application so as to take exception to the charge sheet, however, that order is not complied with by the applicants.

In the circumstances, the application is dismissed as withdrawn with liberty to file application for discharge before the trial Court in case charge is already not framed.
