Mr. Swami, the learned counsel for the petitioner submits that the petitioner has filed appeal against the order suspending the petitioner. The appellate authority is not deciding the said appeal. However, the Chief Executive Officer, Zilla Parishad, Latur has issued notice for framing charges. Learned counsel submits that the respondents ought to have stayed their hands till the appeal filed by the petitioner against the order of suspension is decided. According to learned counsel, the petitioner has made request to respondents to reinstate the petitioner on the same post. 2.

We have heard the learned A.G.P. The appeal filed against the order of suspension is on altogether different premise, the same

wp4203.15 -2would not interfere with the notice impugned in the present writ petition. Moreover, the petitioner is at liberty to file his detailed reply to the purported charges and also participate in the proceeding. 3.
