This application is for condonation of delay in bringing heirs of deceased Respondent No.1/ Rangnath Rambhau Mali on record and setting aside abatement.

Applicant has preferred first appeal against judgment and award passed by the reference court. Respondent No.1 was the sole claimant who died on 26.10.2017. Respondent No.1A to 1E as shown in the cause title of the application are the legal heirs against whom cause of action survives. First appeal is yet to be heard finally. Legal heirs are the necessary parties. Hence, civil application is allowed in terms of prayer clause 'B', 'C' and 'D'.
