IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 68 WRIT PETITION NO. 4152 OF 2018 WITH CA/5546/2018 IN WP/4152/2018 ANAND LAXMAN JADHAV
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioners : Dr. Pansambal Supriya L. AGP for Respondents 1 and 2 : Mr. S.B.Yawalkar ---- CORAM : S.V.GANGAPURWALA AND SUNIL K.KOTWAL, JJ.
DATE : JULY 31, 2018 O R D E R :
We have heard Mrs. Pansambal, learned counsel for the petitioner and learned AGP for respondent nos. 1 and 2.
2.
The petitioner assails the order of approval granted in favour of respondent nos. 4 and 5 as in charge Head Master. According to the learned counsel, the petitioner is senior most teacher and as such has a right to be appointed as Head Master. Respondents are negating the right of the petitioner. The seniority
wp4152.18 list is placed on record.
3.
Mr. Bachate, learned counsel submits that he has filed intervention application on behalf of the real management and seniority list filed along with the petition is improper.
4.
We have also heard learned AGP.
5.
The post of in charge Head Master does not create any right and privileges in favour of the person who has been appointed as in charge Head Master. The petitioner, if feels that he is senior most, can make application to the management for considering his claim for the post of Head Master. 6.
As the post of in charge Head Master does not create any right and privileges, it is not necessary to go in to the merits of the contentions of the petitioner.

Considering the above, we dispose of the Writ Petition. No costs. In view of disposal of Writ Petition, Civil Application is disposed of. [SUNIL K.KOTWAL, J.] [S.V.GANGAPURWALA, J.] dbm
