Heard. This petition challenges rejection of proposal seeking approval of petitioner's appointment as Hostel Superintendent of Tribal Ashram School. Similar petition came before us recently and we examined the issue as to whether there could be different rules for same kind of work in Ashram School. Placing reliance on the judgment of Division Bench of this Court in the case of Sahebrao Karbhari Gunjal & Ors. Vs. Vs. State of

( 2 ) wp273.04 Maharashtra & Ors., 2010(2) Bom.C.R. 165, we allowed the petition and directed the respondents to accord sanction and make payment to the petitioner as per rules. Present petition would also succeed for the reasons mentioned in our judgment dated 3rd September, 2015 in Writ Petition No.806 of 2004.
