BENCH AT AURANGABAD WRIT PETITION NO. 4212 OF 2015 CHANDRAKANT RAMAKANT NAVGHARE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS .....

Advocate for the petitioners: Mr. M.V. Ghatge AGP for respondent Nos. 1 to 3: S.G. Karlekar .....

CORAM : R. M. BORDE AND V. K. JADHAV, JJ.

DATED : 7th MAY, 2015 P.C. :- The petitioners have an apprehension that the Administrator, who is Government official, would be replaced by any non Government functionary or individual and such move would be politically advantageous to rival group. The apprehension expressed by the petitioners appear to be misplaced, since according to the learned A.G.P. Administrator appointed by the State is duty bound to complete the process of elections within six months from the date when he assumes the charge of office. It is stated that the Administrator assumed the charge of office on 30.3.2015 and as such, he is obliged to complete the process of elections within six months from the aforesaid date.

wp4212.15 -22.

The learned A.G.P., on instructions, informs that appropriate steps would be taken in that regard. It is hereby directed that the respondents shall not replace the Government official, who is appointed as an Administrator by making appointment of private individual/s. With directions, as aforesaid, writ petition stands disposed of.
