Heard learned counsel for the applicant. Despite service, no one else appeared on behalf of respondents No.1 to 5. Perused the application.

Present application is moved by the applicant - Insurance Company for condonation of (46) days delay caused in filing the first appeal against the impugned judgment and award passed by learned Motor Accident Claims Tribunal, Bhoom, in MACP No. 73 of 2014. 3.

For the reasons stated in the application and nature of subject matter, in the interest of justice, application deserves to be allowed. Accordingly, the civil application stands allowed in terms of prayer clause "B". The delay caused in filing the first appeal against the impugned judgment and award passed by the learned Motor Accident Claims Tribunal, Bhoom is hereby condoned. Registry to take requisite steps for further process. The civil application stands disposed of. 8.

On registration of appeal, issue notice to respondents, returnable on 7th August, 2018.
