Applicant is seeking direction to the respondent no.4/ University to issue duplicate statement of marks of First Year of Bachelor of Engineering (Information Technology) to her. She has been selected for higher education in the Manchester Metropolitan University. For prosecuting further studies, she is in need of statement of marks of First Year which is not with her. She applied for relevant document to the respondent no.4/ University. University rejected the application stating that her result is reserved for want of eligibility.

Learned Counsel for the applicant submits that his client received communication of 19.05.2024 from International Educational Counselor calling upon her to submit the document. In view of this urgency, direction is solicited. Learned Counsel further informs that applicant completed her graduation and received all the relevant documents including degree certificate, leaving certificate and original documents except the statement of the marks of the First Year of B.E.

Learned Counsel for the respondent no.5 does not have any objection as the directions are mainly solicited against respondent no.4/University. He would submit that respondent no.4/University is competent to issue the document. 5.

Though respondent no.4/University is served, no appearance is caused in the main petition. For the present purpose, the direction sought is innocuous. Considering the urgency in the matter, it would be interest of justice to direct respondent no.4/University to issue the document in question subject to any legal impediment in issuing the document in question.

For the reasons stated herein above, the application is allowed in terms of prayer clause 'B'.
