Heard learned Counsel for the applicant - wife. The respondent - husband, though served with notice but remained absent.

The applicant - wife is seeking transfer of Petition A/316 of 2022 pending in the Family Court, Pune filed by respondent - husband for getting divorce, to the Family Court, Ahemadnagar.

According to the applicant - wife, she is not having any independent source of income and at present she is maintaining four years daughter without any financial support Pooja K.

975-MCA-99-2023 from the respondent - husband. Moreover, she has also filed proceedings under the provisions of Protection of Women from Domestic Violence Act, 2005 against the respondent - husband and for restitution of conjugal rights at Ahemadnagar. The respondent - husband has already appeared in those proceedings. There is no oppose to the application and therefore considering the convenience of applicant, following order is passed : -

ORDER

(i) The application is hereby allowed.

(ii) Petition A/316 of 2022 pending in Family Court, Pune is transferred to the Family Court, Ahemadnagar for disposal according to law.

(iii) The respondent is directed to appear before the Family Court, Ahemadnagar, on or before 25th July, 2023.
