Heard the learned Advocate appearing on behalf of the respective parties.

Both the parties are ad-idem that although on one part of the impugned order it is observed that the application is allowed, in the operative part of the impugned order it is observed that the application is rejected.

Without going into the controversy involved in the merits as it is apparent that there is non-application of mind by the authority, the order below Exhibit 14 in Inquiry No.1213 of 2022 dated 21/03/2023 passed by the learned Deputy charity Commissioner, Nanded is set aside and the matter is remitted back. The concerned authority to decide the application Exhibit 14 on merits afresh and pass appropriate order within a period of eight weeks from the date of production of this order. All contentions are kept open.
