Heard Mr. Deshmukkh, learned Senior Advocate instructed by Mrs. Dube, learned Advocate appearing for the petitioner and the learned A.G.P. for respondent no.1. 2.

The petitioner sought relief in terms of prayer Clause (C), which reads thus:

"The Respondent No.1 be directed to issue sanction to the proposal dated 30.9.2022 (Annexure-"A") with due recommendation dated 20.4.2023 from R. No.2/University for commencement of new course of M.Sc. (Math) in Sharadchandra Arts, Commerce & Science College, Naigaon (Bazar) Tq. Naigaon, District Nanded, run by the petitioner education institute for the Academic Year 2024- 25" 3.

Taking into consideration the prayer Clause (C), which is now restricted to the decision to be taken on the said proposal dated 30.09.2022, the learned A.G.P. was directed to take instructions. Upon instructions, the learned A.G.P. makes a

(2) 26-wp-4143-2024.odt statement that the said proposal has been rejected on 15.02.2024 and it would be communicated by respondent no.1 to the University i.e. respondent no.2 within a period of two weeks. 4.

In view of the said statement, the learned Senior Advocate prays for withdrawal of the petition with liberty to challenge the impugned order of rejection after it is communicated by respondent no.2 to the petitioner.

Under the said circumstance, the petition stands disposed of with liberty as prayed.
