Heard the learned Advocate for the applicant. This application is filed for transferring RCC No.897/2004 pending before the learned 5th J.M.F.C., Panwel to the learned Sessions Court, Nanded. 2.

The learned Advocate for the applicant submits that if the suitable order as regards conducting the evidence of the applicant within particular time frame is passed, he is willing to withdraw this application, as the distance between Panwel and Nanded is approximately 600 kms.

Considering the above, it is directed that the concerned learned Trial Court (5th J.M.F.C.Panwel) shall conduct the evidence of the applicant in RCC No.897/2004 and complete it within one or 2 dates. The applicant shall co-operate in attending the dates of hearing. 4.

With the aforesaid observations, the instant application stands disposed of.
