The learned counsel submits that the petitioner had filed an application under Section 51 of the Maharashtra Public Trust Act seeking permission to institute suit before the Assistant Charity Commissioner, Jalgaon on 31/12/2013, the same is not decided. 2] It is for the petitioner to prosecute his application with the office of respondent no.1. The respondent no.1 would decide the application pending with him on its own merits and in accordance with law. The petitioner may prosecute his application with the respondent no.1. The respondent no.1 shall adjudicate and decide the application filed by the petitioner seeking permission to institute suit (page 16) on its own merits in accordance with law. Considering that

917 wp7700.19 the application is pending from 2013, the respondent no.1 shall endeavor to decide the same expeditiously.

3] Writ Petition is disposed of. No costs.
