PER COURT :- 1.

Applicant prays for condonation of 99 days delay caused in the lodging of the Second Appeal. Reasons and circumstances are set out in paragraph Nos.2 to 8 of the Civil Application. 2.

Learned Advocate for the respondents opposes the application and submits that the reasons cited do not support the request for condonation of delay.

In the light of the above and for the reasons set out in the Civil Application, the same is allowed. Delay of 99 days is condoned, subject to the applicant paying costs of Rs.5,000/- to the respondents. 4.

Shri Patil, learned Advocate for the respondents submits that the said costs be paid to the High Court Advocates' Bar Library, Aurangabad. 5.

In the light of the above, the applicant shall deposit the costs with the High Court Advocates' Bar Library, Aurangabad, within the period of three weeks from today, pursuant to which the Second Appeal shall be registered.
