Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner challenges the order dated 14.03.2022 passed below Exhibit-22 by the Presiding Officer, School Tribunal, Latur in M.A. No.04 of 2021, whereby the application filed by the petitioner seeking condonation of delay came to be rejected.

Learned counsel for the petitioner submits that the petitioner has properly explained the delay, but the learned Executing Court has not considered the same. Even he submits that he is ready to waive the wages from the date of termination till today, if in case the School Tribunal allows the appeal.

Mr. V.S. Panpatte, learned counsel for respondent nos.1 and 2 vehemently opposed the prayers of the petitioner by pointing

925-wp-6605-2022.odt (2) out that the School Tribunal has rightly considered the matter. As far as delay is concerned, he submits that day-to-day delay ought to have explained by the petitioner.

The issue relates to condonation of delay and the employee has filed an appeal against termination along with an application for condonation of delay, therefore, the matter needs to be considered on merit. Therefore, I deem it appropriate to allow the petition thereby allowing the application for condonation of delay. 6.

In view thereof, the petition is allowed. The order dated 14.03.2022 passed below Exhibit-22 by the Presiding Officer, School Tribunal, Latur in M.A. No.04 of 2021 is quashed and set aside, subject to cost of Rs.10,000/- to be deposited by the petitioner within a period of two weeks from today.
