The prayer for transfer of the proceedings is opposed on the ground that the proceedings are initiated pursuant to the cause of action disclosed therein.

When the respondent is confronted on the

75.17mca (2) issue as to whether he is ready and willing to pay conveyance charges to the applicant, learned Counsel reports no instructions.

Considering the convenience and hardship of the applicant, the application, as such, in my opinion, needs to be allowed in terms of prayer clause (A).

Misc. Civil Application stands allowed in above terms.
