PER COURT :

Heard learned counsel for the parties. The applicant along with other accused persons has been convicted for the offence punishable under Section 307 read with Section 34 of the Indian Penal Code and sentenced to undergo rigorous imprisonment for five years and to pay fine of Rs.2000/- each, in default, to suffer S.I. for 6 months. The applicants are also convicted for the offence punishable under Section 506 read with Section 34 of the Indian Penal Code and sentenced to undergo rigorous imprisonment for six months and to pay fine of Rs.500/- each, in default to suffer

S.I. for 2 months. Both the sentences have been directed to run concurrently. The criminal appeal filed by the applicants has been admitted by this Court.

The sentences of imprisonment as against applicants No.2 and 3 has been suspended and they have been directed to be released on bail pending the appeal, by order dated 18/4/2022.

Considering it to be short term sentence, and the fact that the appeal is not likely to come up for hearing in near future, the execution of the substantive sentence of imprisonment imposed upon the applicant to stand suspended pending the appeal and the applicant be released on bail on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount. 4.

Criminal Application stands disposed of.
