IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO. 6119 OF 2014 IN FIRST APPEAL STAMP NO. 21053 OF 2013 Gangadhar Vitthalrao Shankarwar .. Applicant
Versus
The State of Maharashtra Through the Collector, Nanded and others .. Respondents Mr. Ganesh P. Shinde, Advocate for the Applicant. Mr. S. P. Tiwari, AGP for the Respondents-State. CORAM : ANIL L. PANSARE, J.
DATED : 05th JULY 2022.
PER COURT:- .
By present application, the applicant - original claimant who is the appellant is seeking to quash and set aside the order dated 08.10.2013 passed by the learned Registrar of this Court by condoning delay of 167 days. The learned Registrar was pleased to refuse the registration of first appeal on the ground that the appellant failed to remove office objections. The order ought to have been challenged within a period of 30 days from the date of passing the impugned order, however, there is delay on account of obtaining certified copy of the award which is precisely the reason for non removal of objections by the appellant. The appellant has now obtained certified copy of the

2.
In view of the above, the delay stands condoned. The order dated 08.10.2013 is quashed and set aside. The first appeal is restored on file to its original status. The appellant to remove office objections within a period of fourteen days from today, failing which the order passed by the learned Registrar will revive.

Civil application is disposed of in above terms. ( ANIL L. PANSARE ) JUDGE P.S.B.
