This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicants have been arrested in connection with Crime No.0220/2021, registered with Tembhurni Police Station, District Jalna, for the offence punishable under Section 302 of the Indian Penal Code.

Perused the First Information Report (FIR) and the related police papers.

The applicant is alleged to have committed murder of his wife. According to the learned Advocate for the applicant, the applicant was not at home when his wife breathed her last. According to him, the charge-sheet has been filed and it will take time for conclusion of trial. The case is based on circumstantial evidence. He, therefore, urged for grant of bail. 4.

The learned APP would, on the other hand, submit that it was the house shared by the applicant, his deceased wife and their minor daughter. The statement of their daughter indicates that just 30 - 35 minutes before the death of the applicant' s wife, there was quarrel between her and the applicant, and the applicant had slapped her. Admittedly, the deceased was found strangled in the house shared by the applicant alone, except their minor daughter. As such, it is for the applicant to come clean during trial of the case. The Court is not inclined to grant him bail.
