CORAM : S. V. GANGAPURWALA & R. G. AVACHAT, JJ.
DATED : 19th JUNE, 2020.
PER COURT:- 1.
We have heard Mr. Dhorde, learned senior counsel for the petitioner.
2.
The learned senior counsel submits that in view of the Government Resolution dated 04.05.2020 works of Dalit Vasti could not be undertaken. The said Government Resolution is issued because of extraordinary situation prevailing due to COVID-19 pandemic. The learned senior counsel refers to Clauses 4, 11, 13 and 17 of the Government Resolution dated 04.05.2020.
(2) 965-wpst-10643-2020 3.
Mr. Kadam, learned counsel for Zilla Parishad and the learned A.G.P. submits that subsequently Corrigendum dated 14.05.2020 is issued wherein relaxation has been given. The 40% funds are already disbursed to the Village Panchayat. The work orders are already issued.
4.
As the funds are already disbursed to the respective Village Panchayat and work orders are already issued, it would not be appropriate at this stage to stall the development work. It is for the Government to consider all the aspects. The Government naturally would never take plea that it does not have funds to fight against COVID-19 pandemic.
5.
In view of that, writ petition is disposed of. No costs.
6.
In view of disposal of writ petition, present civil application is also disposed of. (R. G. AVACHAT) (S. V. GANGAPURWALA) JUDGE JUDGE Devendra/June-2020
