The learned counsel appearing for the respondents no.2 and 3 on the instructions, states that the respondent no.1 has already approached N.C.L.T. and as such the auction proceeding, which was scheduled on 29/08/2017 has been cancelled by the Bank.

The communication issued to the learned counsel for respondent is taken on record and marked 'X' for identification. In view of the cancellation of auction proceedings, grievances raised by the petitioner does not deserve to be considered. Keeping the option open to the petitioner to avail of remedy available in law as and when cause of action accrues, the Writ Petition stands disposed of.
