PER COURT :- 1.

The petitioner / husband is aggrieved by the order dated 5.12.2018, by which, the trial Court has granted interim maintenance to the wife at the rate of Rs.4,000/- per month and to the three children, who are taking education, at the rate of Rs.2,000/- per child.

The petitioner contends that though he is a Teacher with Primary School Darsod Wadi (Bhojdari), Zilla Parishad, Ahmednagar, at Sangamner, his monthly salary is only Rs.43,626/-. Per contra, the wife has placed on record the October, 2017 salary slip indicating the gross salary of the petitioner as Rs.1,05,778/-. He has irrigated land at Pokhari Baleshwar and earns about Rs.15,00,000/- per annum. 3.

BENCH AT AURANGABAD 2-WRIT PETITION NO.9256 OF 2019 salary is not Rs.1,05,778/- and it is only Rs.43,626/-, I deem it appropriate to take the assistance of the learned AGP so as to request the Deputy Chief Executive Officer to tender the gross salary certificate of the petitioner for the month of July 2019. It is made clear that if the statement of the petitioner turns out to be false, I would be enhancing the maintenance to Rs.20,000/-. 4.

At this juncture, the petitioner, present in the Court, has instructed the learned Advocate to withdraw this petition. 5.

Considering the above, this petition is disposed off as withdrawn, on instructions.
