By WP No.4251/2022, the petitioner was aggrieved by the order dated 17.03.2022 which was issued by the Education Officer (Primary), in the teeth of the order dated 08.10.2021 passed by this Court in WP No.7458/2021 vide which the C.E.O., Zilla Parishad was to take a decision on his representation for transfer.

The learned Advocate representing the Zilla Parishad has placed on record an order dated 20.05.2022 passed by the C.E.O., Zilla khs/June 2022/6811

- 2 - Parishad, Aurangabad. It is conceded that the Education Officer should not have indulged in passing the order dated 17.03.2022. The said order is now replaced by this order dated 20.05.2022, marked "X" for identification.

In view of the above, this petition is disposed off. Pending civil applications do not survive and stand disposed off. 4.

We grant liberty to the petitioner to avail of a remedy as is permissible in Law for challenging the order dated 20.05.2022. ( ANIL L. PANSARE, J. ) ( RAVINDRA V. GHUGE, J.) khs/June 2022/6811
