Learned counsel appearing for the applicant invited our attention to the order dated 11/8/2017 passed by this Court in Civil Application No.3371/2017 in First Appeal No.1967/2009 and submits that the facts in this case are identical to the facts before this Court in the said order. Mr. Dande, learned counsel for respondent No.1 does not dispute this position. 2.

Civil Application is accordingly made absolute in terms of prayer clause (A) on furnishing security to the satisfaction of the Registrar (Judicial) of this Court. Civil Application is disposed of in aforesaid terms. No order as to costs.
