Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner challenges the order dated 14.09.2018 passed by the Education Officer, Zilla Parishad, Aurangabad and the order dated 24.08.2021 passed by the Divisional Commissioner, Aurangabad.

Mr. Munde, learned counsel for respondent/Zilla Parishad points out that the order was passed by the Education Officer under Maharashtra Zilla Parishads District Services (Discipline and Appeal) Rules, 1964 ('Rules of 1964' for short). Against that, present petitioner filed an appeal under Rule 13 before the Divisional Commissioner and Additional Divisional Commissioner dismissed the appeal filed by the petitioner, therefore, the petitioner can file revision before the State Government under Rule 15 of the Rules of 1964.

In view of the above, petition is disposed of as not maintainable with liberty to the petitioner to file revision before the State Government within a period of six weeks from today. All points kept open.

The time spent while prosecuting this petition shall be taken into consideration by the State Government while considering the application for condonation of delay.
