Heard Mr. Bora, learned counsel for the petitioners, learned AGP for the respondents State, Mr. V. B. Patil, learned counsel for Respondent No.5 in WP/3939/16 and Mr. N. N. Desale learned counsel for for Respondent No.4 in WP/4838/2016.

Learned counsel for both the sides have stated that petitioners have efficacious remedy available before the Maharashtra Administrative Tribunal and therefore both the petitions may be transferred to the Maharashtra Administrative Tribunal.

The Registry of this Court is directed to transfer the writ petition Nos. 3939/2016 and 4838/2016 1/2

to the Registry of the Maharashtra Administrative Tribunal. On receipt of the petitions, the Registry, M.A.T. to register these petitions as original applications.

Learned counsel for the petitioners undertake comply with all the requisite formalities necessary to be completed.

The parties are directed to appear before he Maharashtra Administrative tribunal on 06.04.2017. The parties are at liberty to file additional affidavits. The Tribunal shall dispose of these original applications within four weeks from the date of appearance.

6.

Writ Petitions are accordingly disposed of.

7.

Interim orders operating in the above writ petitions to continue till disposal of the original applications.
