The Petitioner is a superannuated employee of the Municipal Council, Nandurbar. His only grievance is that his retiral benefits, pensionary benefits, gratuity etc. are not being paid to him. He submits that there is no legal impediment. No charge-sheet was issued to him. No disciplinary action is initiated or was earlier conducted against him.

The learned Advocate representing the Municipal Council submits that the Municipal Council lacks funds.

In view of the above and considering the several orders passed in identical matters, this Writ Petition is disposed off with the following directions :- a) The pension proposal of the Petitioner shall be forwarded and cleared within 90 days from today. b) All retiral monetary benefits shall be computed by the Municipal Council within 15 days and the total amount along with accrued interest, shall be paid in 4 installments to the Petitioner.

c) The first installment shall be paid on or before 10.06.2024 and the remainder three installments shall be paid, on or before the 10th day of the months of July, August and September, 2024.
